National Judicial Appointments Commission (NJAC)
Parliament enacted the National Judicial Appointments Commission(NJAC) Act for the appointment and transfer of judges to the Supreme Court and High Courts.It is noteworthy that the Chief Justice of India was to preside over this commission which appointed the judges.
In addition,two senior judges of the Supreme Court, the Union Law Minister and two eminent persons would also be part of this commission.
These two personalities were to be selected by a three-member committee consisting of the Prime Minister, the Chief Justice and the Leader of the Opposition in the Lok Sabha or the leader of the single largest opposition party.
An important thing related to the commission was that if no two members of the commission agree on the appointment of a person, then the commission does not recommend the appointment of that person to the President.
The National Judicial Appointments Commission Act was challenged in the Supreme Court and the Court declared the Act unconstitutional holding that the NJAC in its present form is merely an interference in the functioning of the judiciary and thus destroys the independence of the judiciary.
